Boston Partners Tory Weigand and Noel Dumas recently presented to Coverys on the issue of bad faith claims against insurers at Coverys's annual national claims conference. The presentation included a discussion of trends in bad faith claims, particularly in light of the increasing number of these claims as well as practical practice tips from a risk management prospective to aid in the defense of bad faith claims.
Specific topics presented included both a summary of the pertinent law (the duty to defend and the duty to settle) as well as a demonstration utilizing two recent bad faith cases Attorney Weigand and Attorney Dumas defended. The demonstration aspect of the presentation included the dissection and analysis of actual emails, portions of claim files, and expert consultant reports involved in those two cases.
The presentation concluded with practice tips and take away points to incorporate in the practice of claim representatives and claim supervisors to assist in the defense of a bad faith claim. The interactive nature of this presentation was well received by Coverys and initiated a thoughtful and interesting question and answer session.
