Morrison Mahoney partner Mike Racette has been quoted on the front page of Massachusetts Lawyer’s Weekly for January 22, 2018. Mike commented on an Appeals Court decision holding that deposition testimony could be admitted when the witness was not available due to pleading the 5th at trial.
The Massachusetts Appeals Court held for the first time that a witness’ deposition testimony can be used at a civil trial under the prior recorded testimony exception to the hearsay rule where the witness is unavailable due to a valid invocation of the privilege against self-incrimination.
