New Jersey Partner Christopher Martin, along with Associates Neil Tortora and Lina Corriston, secured summary judgment in favor of our client in a real estate broker errors and omissions matter. The claims involved negligence, misrepresentation, and fraudulent inducement with regard to a dual agency agreement. The subject property was within a few feet of an easement which was to lead to a new housing development with heavy traffic. Our client was able to establish that the duty to address the easement was not with the broker but with the surveyor, title company, and closing attorneys. It was also shown that any statements by the broker in this context were immaterial.
