New York Partner Brian Heermance and Associate Chris Keenoy obtained summary judgment in a construction defect case. The plaintiff alleged that she fell on black ice in a parking garage. Brian and Chris argued that our client, the contractor who erected the garage, had no role in designing or manufacturing the prefabricated components nor did it have any role in waterproofing the concrete. By establishing that our client was free from negligence for plaintiff’s incident, Brian and Chris established that the indemnification clause in the contract was never triggered and that all claims and cross-claims must be dismissed.
