Hartford Partner Jim Brawley and Stamford Partner Mike Keller recently obtained summary judgment in a legal malpractice case involving allegations of breach of fiduciary duty against our attorney client for his role in serving as co-executor. Plaintiff did not provide any expert testimony on the applicable standard of care. The defendants argued that the standard of care for a co-executor in this situation was outside the common knowledge of the average juror.
