Boston Partners Michael Racette and Tony Abeln obtained a “no negligence” defense verdict after a three-week trial in a case brought against the chief of anesthesiology at a hospital where the plaintiff alleged negligent post-operative monitoring following routine knee replacement surgery. After cross examination of the Plaintiff’s expert cast serious doubt on the expert’s opinion that the plaintiff’s eventual death had been caused by the events two years earlier, the jury further rejected the plaintiff’s attorney’s attempted refocus on the claim that the intervening neurologic injuries were caused by our client’s alleged negligence.
