New Jersey Partner Christopher Martin and Associates Lina Corriston and Seth Garrod obtained a victory in the Superior Court of New Jersey, Appellate Division where the court affirmed a trial level dismissal with prejudice on a professional malpractice matter. Our doctor allegedly deviated from the standard of care in the treatment of a patient, however plaintiff’s counsel did not produce the necessary Affidavit of Merit by the proper deadlines. When the Affidavit was finally produced it failed on its face substantively. The procedural and substantive failures as a matter of law required the case to be dismissed at the trial level and affirmed at the appellate level.
