Boston Partner Tony Abeln recently obtained a defense verdict in a six day jury trial in Suffolk Superior Court, in what the judge referred to as a “Gladiator Match.” The Plaintiff, a twenty-eight year old woman, had surgery for an ectopic pregnancy and suffered from two complications during the procedure, resulting in significant internal bleeding and the removal of an ovary. The additional “complication” in the case was that the co-defendant noted in the medical records as well as in discussions with the Plaintiff that there were things that could have been done better during the surgery itself. Additionally, Tony would like to extend his thanks to the videoconferencing technology involved in the trial. As Plaintiff’s expert was snowed in and unable to make it to trial, the parties used Suffolk Superior’s videoconferencing technology to have the expert testify live from Florida. Key moments in Plaintiff’s direct examination were interrupted with static-filled delays.
