Morrison Mahoney partners Kathleen Federico and Gareth Notis obtained a defense verdict in a four-week product liability and premises liability trial in Suffolk Superior Court in Boston.

The plaintiff was a carpenter hired by a homeowner to install glass hockey panels at the homeowner’s professional grade, outdoor hockey rink.  The plaintiff was crushed by a ton of glass while opening a delivery crate containing the hockey glass.  Gareth and Kathleen represented the homeowner who allegedly failed to provide adequate warnings to the plaintiff, and failed to retain a sophisticated contractor to handle the crate and install the hockey glass.  The plaintiff also brought suit against the manufacturer of the glass and the distributor who allegedly failed to provide adequate instructions and covered a warning label on the crate prior to delivery.

After a full day of deliberations, the jury returned a defense verdict for Gareth and Kathleen’s client and a verdict of $4.5 million against the manufacturer and distributor.
