Functional imparity, limits of inherent powers: the right to a jury of 12 in the Superior Court

Morrison Mahoney Partner Tory A. Weigand was recently published in Massachusetts Lawyers weekly questioning the suspension of the right to a jury of 12 in the Superior Court and suggesting that jury size is an indispensable attribute of the constitutional right to a jury trial including under the Massachusetts Declaration of Rights.
