Morrison Mahoney Partner Brian Suslak recently obtained a courtroom success before the Massachusetts Appeals Court following oral argument. 

The plaintiff alleged that our insurer client and its insureds were vicariously liable for the alleged improper conduct of an IME doctor retained by defense counsel in a previously-filed lawsuit arising out of a 2010 car accident. The Appeals Court rejected the plaintiff’s argument and upheld the trial court’s entry of summary judgment in favor of our clients, ruling that the plaintiff had failed to produce any evidence establishing supervision or control by our clients over the IME doctor.
