Morrison Mahoney Associate Erin Hoefler recently obtained a defense verdict following a two-day jury trial in New Hampshire Superior Court (Hillsborough County, North).
The case arose out of an auto accident in a parking lot. The plaintiffs claimed that our client’s car struck theirs after the plaintiffs fully had exited their parking space. Alleged damages included specials approaching $20,000 and a 5% whole-body impairment rating. Our client, a young college student, claimed that the accident occurred because the parties had attempted simultaneously to reverse their motor-vehicles from their respective parking spaces. The lone witness to the accident offered deposition testimony favorable to the plaintiffs.
Erin primarily argued the absence of any negligence on the part of our insured, and she repeatedly impeached both plaintiffs by exposing material inconsistencies in their testimony. She also established via demonstrative evidence that the accident could not possibly have occurred in the manner claimed by the plaintiffs.
The jury deliberated for less than a half hour.
