Trial Verdict 2018-27: Morrison Mahoney Partners John Knight and Chris Davidson

John Knight and Chris Davidson obtained a defense verdict following a 4‑day trial in which the plaintiff sought to recover damages for a fractured ankle resulting from an alleged fall on the defendant's property.  The plaintiff was a tenant in property which had been foreclosed upon, and the client was a successor in interest to the property.  The plaintiff claimed that a landing area on the rear of the property had deteriorated over time and claimed that the defendant was negligent in its role as the property landlord.  As a result of the injuries which the plaintiff sustained, he incurred approximately $35,000 in special damages.  At trial, the defense challenged whether the plaintiff was injured as a result of an alleged property defect versus some other underlying event and also established that the property was appropriately maintained.  The jury returned a defense verdict after 20 minutes of deliberating.  Special thanks to law clerk Michael Filbin for his assistance at trial.
