Boston Partner Scott Burke obtained a dismissal of a Contempt Complaint and also obtained judgment in favor of the the firm's clients on all issues. The Massachusetts Attorney General (AG) filed in August 2012 a contempt action against the firm's client and his clients for alleged violation of a Final Judgment by Consent ("FJC") entered in June 2012. After two days of trial, the trial judge granted our pre-trial motion to dismiss our client from the case because the FJC did not provide the appropriate notice that our client could be held in contempt for violating the statute. Following the dismissal of our client from the case, our client's client retained Scott to continue as co-counsel for one of the corporate defendants. The case was tried over nine days before being dismissed.
