Morrison Mahoney Partner Tory Weigand recently prevailed on appeal in the Supreme Judicial Court. The appeal centered on the issue of appellate procedure for challenging adverse determinations and denial of a request to reduce malpractice bond by the Superior Court when an action was filed and pending in Federal District Court. The Supreme Judicial Court agreed that any appellate challenge or appeal from such Superior Court rulings must be made before the Federal District Court. It held that the appellate courts of Massachusetts are without jurisdiction to hear such appeals on such referred matters as jurisdiction remains in the Federal District Court.
