Morrison Mahoney Partner Tory A. Weigand, with the invaluable assistance of Associate Stephen Orlando, recently obtained a defense verdict in a medical malpractice action following an eight-day jury trial in Woburn Superior Court.

The defendants included a gastroenterologist/endoscopist and hospitalist who were alleged to have been negligent as to the development and delayed diagnosis of a duodenal perforation suffered as a result of an endoscopic procedure addressing a GI bleed. The claimant was 60 years of age and developed serious and lengthy complications from the perforation including the need for further surgery and home nursing care. She was unable to return to work.

The trial involved the testimony of five medical experts with the plaintiff’s liability expert conceding to certain “mistakes” in his opinion on cross-examination. We presented strong expert testimony on behalf of our client. The jury deliberated for 4.5 hours before rendering its defense verdict.
