Boston Partner Grace Garcia obtained Summary Judgment in the Suffolk Superior Court in favor of a general contractor. Specifically, Grace argued that a subcontractor breached a written subcontract agreement by failing to indemnify the general contractor in a significant personal injury case. The subcontractor argued in response that the subcontract was not enforceable at the time of the accident as it was not signed until after the accident, and that even if the contract was enforceable, the indemnity provision had not been triggered. After submission of written arguments and oral arguments on the issue, the Superior Court granted Grace’s Motion for Summary Judgment on behalf of the general contractor, finding that the subcontract was enforceable and the indemnity provision had been triggered.
