Morrison Mahoney Partners Christopher Martin and Neil Tortora obtained a defense verdict where the plaintiff alleged an accident at a hospital café due to a defective floor surface. The plaintiff worked in the shipping department of a hospital and claimed to have been making a delivery to the café when he fell on a slippery surface. He had knee surgery and was claiming the need for a total knee replacement. Discovery showed the plaintiff had multiple versions of the accident and how he sustained a knee injury. This aspect alone was looked upon with skepticism by the judge and jury, however, the judgment was ultimately in favor of our client based upon the plaintiff not being able to prove negligence. The testimony and demonstrative evidence did not allow for a finding of foreseeability by our client of any hazard or defect and did not show that the conduct of our client was anything but reasonable under the circumstances.
