Morrison Mahoney Partner Christopher Martin and Associate Kohar Boyadjian secured summary judgment on a professional engineering malpractice case. Our client was a civil engineer providing professional services in terms of site design and water system design for a large commercial multi-unit development. Damages to multiple units occurred from a water surge in the fire protection system. The plaintiff filed an Affidavit of Merit but not one authored by the appropriate engineering professional. The court agreed with our arguments and dismissed the action with prejudice finding that the plaintiff’s expert, although a licensed engineer, was not qualified to opine on a deviation in the standard of care through a required Affidavit of Merit, as the expert did not perform in his practice civil engineering services which were the type of services at issue.
