The case involved a nursing home patient who suffered a series of falls and died after the last one. The plaintiff sued the nursing home and the nursing home’s weekend nurse supervisor, arguing that the individual nurse failed to reassess the resident after she sustained a fall with head injury that required hospitalization. The facility made no change to the resident’s care plan upon her return from the hospital and she sustained the fatal fall later that day. The defense successfully argued that the existing care plan was appropriate despite the intervening head injury. After brief deliberation, the jury found no negligence against either the nursing home or the individual nurse supervisor. This was Joe’s sixth straight defense verdict for the client.
