Boston Associate Colin Barrett obtained the dismissal of a bar discipline complaint. Our client is involved in litigation in Probate Court with his former partner. The ongoing civil litigation concerns, in part, a dispute over interest in certain real property. It is alleged that our client assisted in the acquisition of the property and the subsequent formation of trusts. His former partner’s civil attorney filed a complaint with the Office of Bar Counsel alleging that the allegations in the civil complaint constituted violations of the Rules of Professional Conduct. We successfully argued that the bar discipline complaint was filed to gain leverage in the pending civil action and none of the alleged conduct, even if true, constituted violations of the Rules of Professional Conduct. We also argued that the attorney did not participate in the execution of documents purportedly giving him an interest in the property.
