Boston Partner Brent Tingle and Associate John Babcock won a defense verdict after a one-week trial in Norfolk Superior Court. The case involved a 55-year old man who died of a cardiac condition at work only two weeks after our cardiology client had performed a cardiac stress test on him. The plaintiff argued that our client misinterpreted the data from the stress test and missed evidence suggestive of severe coronary artery disease. An autopsy confirmed that the patient had severe coronary disease which would have been treated if diagnosed. The defense expert argued that our client had properly interpreted the stress test data and that unfortunately many patients will experience sudden cardiac death with no warning symptoms. The jury deliberated for only an hour before returning a verdict for our client.
