Boston Partner Jim Bello recently obtained a directed verdict in a medical malpractice matter tried in New Hampshire. The case involved allegations that our client, an orthopedic surgeon, was negligent in the performance of a total knee replacement. The plaintiff’s expert was unable to establish causation to a reasonable degree of medical certainty, leading to the motion being filed upon the conclusion of his testimony. Plaintiff’s counsel filed a motion to re-call the expert, but the motion was denied.
