Boston Partner Grace Garcia recently obtained summary judgment from the Bristol Superior Court on claims of negligence, breach of warranty, breach of warranty of merchantability, and violations of M.G.L. c. 93A. Plaintiff argued that as a result of eating dinner at the defendant’s restaurant he contracted salmonella poisoning. Grace argued that plaintiff was unable to prove causation although the plaintiff was hospitalized shortly after eating at the restaurant. Plaintiff failed to produce sufficient evidence to substantiate that the food ingested at the restaurant was the cause of the salmonella.
