Boston Partner Gareth Notis recently prevailed before the Massachusetts Appeals Court in a matter involving disability discrimination, retaliation, and a Whistleblower statute violation brought by an employee against her employer and her direct supervisor. The plaintiff alleged that her request for a reasonable accommodation for her disability was denied, and that she was demoted and retaliatory acts were taken against her merely because of her reports of a hostile work environment. She also alleged that the employer retaliated against her, in violation of the Massachusetts Whistleblower statute, after she reported breaches of regulations governing her workplace to a state agency. The Appeals Court affirmed a Superior Court Order granting Summary Judgment ruling that plaintiff was properly accommodated and there was no causal relationship between her protected activities and any adverse action taken against the plaintiff.
