Courtroom Success 2016-5: Boston Partner Scott Burke & Associate Colin Barrett

Boston Partner Scott Burke and Associate Colin Barrett successfully obtained a dismissal of the plaintiff’s legal malpractice action in Worcester Superior Court. The plaintiff’s claims arose from our client’s role as the court appointed administrator of the plaintiff’s mother’s estate. The plaintiff was dissatisfied with the determination of his inheritance, which was based upon a GAL report issued years prior to our client’s involvement. The plaintiff brought suit against our client as well as the other attorneys involved in the probate proceedings in an apparent attempt to re-litigate the estate issues. We raised arguments based upon collateral estoppel and the long expired statute of limitations. The court dismissed the complaint based upon the expiration of the statute of limitations.
