Boston Partner Ted Murphy received an appellate decision in favor of our client, a large Naval defense contractor. The case was brought under the Longshore and Harbor Workers’ Act, 33 U.S.C. Sec. 901, and involved allegations of stress-induced psychiatric and cardiac ailments, leading to a career-ending disability. The Washington, D.C., based court affirmed the trial judge’s finding that the claim was time barred notwithstanding numerous arguments that would have tolled the statute of limitations.
