New Jersey Partner Christopher Martin and Associate Neil Tortora obtained summary judgment in a commercial property liability matter. The plaintiff was a real estate and rental agent for a large national developer, however, she claimed that she was an independent agent and not an employee of our developer Client. The plaintiff suffered significant leg fractures and surgeries as a result of walking in an area of new construction which was not fully completed. Factual and legal analysis was provided to the court showing the agency relationship was that of an employee and not an independent person or entity for sales and rental duties at the development. The court agreed with this analysis and entered summary judgment in favor of our client.
