Boston Partner Sean Milano and Associate Meredith Lasna recently obtained summary judgment in the U.S. District Court in Boston on behalf of our retailer client in a matter involving a claim for injuries to a customer. The plaintiff customer was injured while he rode his motorized scooter through an automatic door that did not open when he approached. The plaintiff argued unsuccessfully that the retailer negligently failed to warn that the doors are immobilized when there is someone on the other side and, that absent such a warning, the doors were unreasonably dangerous. Summary judgment was supported by video of the incident showing the door operating in a normal fashion, as well as an affidavit that it operated as designed and in accordance with industry standards.
