Boston Partner Grace Garcia and Associate Steve Troiano recently obtained dismissal of claims brought against an electric utility company in Essex Superior Court. The plaintiff suffered severe injuries and lost both arms while working as an electric lineman on a high voltage power line. It was claimed that our client improperly designed and constructed the utility pole upon which plaintiff was injured. We successfully argued that utility poles qualify as an improvement to real property and thus the claims were barred by the statute of repose because the alleged work was not performed within six years of plaintiff’s accident.
