Worcester Partner Joanne Gulliford Hoban and Associate Kerry Courtney obtained a defense verdict in a two-week trial in Suffolk Superior Court. The plaintiff alleged our client’s hospital did not properly monitor a patient who had been admitted for dementia. The patient fell and fractured his hip. Plaintiff alleged conscious pain and suffering and wrongful death against the hospital and a nurse. The defense argued, contra the plaintiff’s assertions, that the patient had been appropriately monitored and assessed for fall risk, that a velcro belt was properly used, and that fall was witnessed by staff who were appropriately caring for him. The jury deliberated for approximately four hours before returning a defense verdict.
