Boston Partner Joe Desmond and Associate Alexandra Gordon obtained a defense verdict in a three-week trial in Middlesex Superior Court. The plaintiff was admitted to our client’s nursing and rehabilitation facility for physical therapy. The plaintiff contended that she was oversedated with narcotics resulting in multiple falls, the last of which left her unconscious on the floor of her room. The plaintiff claimed that she broke her hip, which required surgical repair and long term nursing home placement. The defense argued that she was appropriately medicated, fall precautions were appropriate, and the plaintiff’s last fall was caused by a seizure or syncopal event rather than narcotic overdose. The jury deliberated for five hours before returning a defense verdict.
