Boston Partner Peter Knight and Associate Jake Struck, along with paralegal Dianne Starett and legal assistants Ronna Nesselle and Karen Guiney, obtained a defense verdict after a one-week trial in the Bristol Superior Court.

Our client, an orthopedic surgeon, allegedly transected plaintiff’s quadriceps tendon during knee surgery. In light of record-keeping errors and other challenges, the defense’s strategy was to focus on the fact that radiographic evidence precluded any possibility that our client injured plaintiff’s quadriceps during the procedure. Plaintiff countered that the surgeon was operating “blind.”

On the second day of deliberations, the jury came back and found that while our client was negligent in his care of plaintiff, his negligence did not cause any injury or harm to her.
