Joseph M. Desmond

Joseph M. Desmond is a Partner in the Boston and New Hampshire offices of Morrison Mahoney LLP.  Since joining the firm, Mr. Desmond's practice has concentrated in the trial of third-party lawsuits with particular emphasis on the defense of nursing home, assisted living facility and clergy sexual abuse cases.  Mr. Desmond has successfully represented defendants in a variety of other general liability matters, and has developed an expertise in the defense of cases involving claims of traumatic brain injury.

Mr. Desmond is admitted to the Bar of the Commonwealth of Massachusetts, the United States District Court of Massachusetts and the State of New Hampshire.  Mr. Desmond is a member of the American Bar Association; the Defense Research Institute and the Massachusetts Bar Association.  Mr. Desmond has been an invited speaker at national risk management forums and has lectured at continuing education seminars sponsored by the Massachusetts Bar Association and Massachusetts Defense Lawyers Association.  Mr. Desmond has also published numerous articles concerning long-term care liability and general liability litigation.

Mr. Desmond successfully argued that arbitration agreements in the context of nursing home admission contracts are enforceable before the Supreme Judicial Court in Miller v. Cotter, 448 Mass. 671 (2007). Click here to view his argument.
